Columbia, S.C. – Pennington Law Firm, L.L.P. was recently named in South Carolina Lawyers Weekly as successfully litigating one of the state’s 50 Most Important Opinions for the second year in a row. In 2008, Pennington’s Jessica Clancy Crowson and Gary C. Pennington victoriously represented SCE&G and SCANA Communications, Inc. in defending the rezoning of a 7-acre tract owned by SCANA on Edisto Island. The rezoning allowed SCE&G to construct a cell phone tower. ATC South, Inc., a competitor tower owner challenged the rezoning. After oral argument, the South Carolina Supreme Court in the published opinion of ATC South, Inc. v. Charleston County et. al., denied ATC standing, holding that a mere business competitor lacks the standing to challenge such a zoning decision.

Columbia, SC - The Pennington Law Firm, LLP is proud to announce that it has successfully obtained on behalf of its client Verizon Wireless, working in concert with Duke Energy, a Conditional Use Permit for the construction of a new wireless communications facility in the Town of Cornelius, North Carolina. The new wireless communications facility will be located at the corner of Jetton Road and Lake Norman Cove Drive in Cornelius, North Carolina. The new communications facility will allow Verizon Wireless to provide better wireless voice and broadband coverage in the businesses and residential homes located in the Peninsula area. The Firm achieved success in this very difficult zoning case by working diligently with Town Staff and the local Homeowners Associations. After two (2) public hearings, the last of which lasted approximately three (3) hours, the Conditional Use Permit Application was approved by a 5 to 1 vote on November 5, 2007.

Columbia, SC – It was announced today that Gary C. Pennington has been appointed to serve as a member of the South Carolina Broadband Technology and Communications Study Committee as the designee of Joe E. Taylor, Jr., Secretary of the SC Department of Commerce.
The South Carolina Broadband Technology and Communications Study Committee was created pursuant to Act 169 of 2007 by the state General Assembly. Its purpose is to evaluate how best to foster a partnership between the private and public sectors to ensure that all South Carolinians have affordable access to wireless and broadband products and services.
